Terms & Conditions

The rules of the road for using Ekhopost. Part A covers every account. Part B adds the specifics for paid plans.

These Terms & Conditions (“Terms”) govern your access to and use of ekhopost.com and the Ekhopost app — the AI social‑posting platform that turns a rough idea into on‑brand posts for LinkedIn, Instagram, Facebook, and X (collectively, the “Service”), operated by Ekhopost (“we”, “us”, “our”). The Terms are split into two parts: Part A applies to every user who creates an account; Part B applies to paid subscribers in addition to Part A. By ticking “I agree” or continuing past the login screen, you confirm you have read, understood, and accepted these Terms.

Statutory basis. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and constitute a binding contract under the Indian Contract Act, 1872. No physical or digital signature is required.

Account terms — everyone

Applies from the moment you create an Ekhopost account.

Eligibility & capacity to contract

You must be at least 18 years of age and competent to contract under Section 11 of the Indian Contract Act, 1872. Users under 18 may not create an account.

If you register on behalf of an organisation, you warrant that you are authorised to bind that organisation to these Terms.

You must not be a person barred from receiving services under applicable Indian law, including any sanctions list.

Account creation

Registration requires a valid email address and, where applicable, a mobile number. Third‑party sign‑in (Google, Apple) may be offered; use of those methods is subject to the third party’s terms in addition to ours.

You agree to provide accurate, current, and complete information and to keep it updated. We may reject or cancel registrations that contain information we reasonably believe is false, misleading, or duplicative.

One natural person, one account. Automated, scripted, or bulk account creation is prohibited.

Credentials & account security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorised by you.

You must notify us immediately at hello@ekhopost.com of any suspected unauthorised access or security breach. We are not liable for losses caused by your failure to safeguard credentials.

We may require re‑authentication, multi‑factor verification, or a password reset at our discretion to protect the Service.

Consent to data processing

By creating an account, you provide informed consent under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) for us to collect, store, and process personal data strictly for the purposes of:

  • operating the Service, including generating posts and images on your behalf;
  • storing your brand library (logo, palette, tone preferences) so generated content stays on‑brand;
  • authenticating and maintaining your connections to third‑party social platforms (LinkedIn, Instagram, Facebook, X);
  • authenticating your account, processing payments, and preventing fraud;
  • communicating service updates and, where separately opted in, marketing;
  • complying with law.

You may withdraw consent at any time from account settings or by writing to hello@ekhopost.com. Withdrawal may limit or end your ability to use the Service.

Acceptable use at the access stage

In creating or accessing an account, you will not:

  • impersonate any person, misrepresent your identity, or use credentials that do not belong to you;
  • use bots, scrapers, credential‑stuffing tools, VPN/proxy rotation, or other automation to bypass rate limits or login protections;
  • probe, scan, or test the vulnerability of the login system, or breach authentication or security measures;
  • circumvent regional, device, or account‑level restrictions that we apply.

Cookies & tracking at login

We use strictly necessary cookies to run the login flow and session management. Analytics or advertising cookies, if any, are only set after you provide separate consent via our cookie banner.

Suspension & termination of access

We may suspend or terminate your access without prior notice if we have reasonable grounds to believe that you have breached these Terms, violated applicable law, or created a security risk.

You may close your account at any time from the account settings page. Closure does not extinguish accrued payment obligations under Part B.

Intellectual property (site‑level)

All content on ekhopost.com — marketing copy, photographs, videos, logos, trade marks, and page design — is owned by or licensed to Ekhopost and is protected by the Copyright Act, 1957 and the Trade Marks Act, 1999.

No scraping, indexing, republication, or automated ingestion of the marketing site or the app is permitted without our prior written consent.

The Ekhopost name, mark, and brand identity are the property of Ekhopost.

Disclaimers

The Service is provided on an “as‑is” and “as‑available” basis. We do not warrant that the Service will be uninterrupted, secure, or error‑free.

The Service uses artificial intelligence to generate text and images. AI output may be inaccurate, incomplete, biased, or fail to reflect current facts. You are responsible for reviewing and approving every post before it is published. We do not warrant the accuracy, legality, or suitability of any AI‑generated output for any particular purpose.

Limitation of liability (pre‑paid)

To the maximum extent permitted under Indian law, our aggregate liability to you for any claim arising from your access to the Service before any paid subscription shall not exceed INR 1,000.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, reputation, goodwill, or profits.

Changes to these Terms

We may amend these Terms from time to time. Where changes are material, we will notify you by email or an in‑product banner before they take effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.

Governing law & dispute resolution

These Terms are governed by the laws of India.

Subject to the Consumer Protection Act, 2019 where applicable, the courts at Delhi have exclusive jurisdiction.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the DPDP Act, 2023, our designated Grievance Officer is:

PART B

Paid subscribers

Applies when you purchase a paid subscription. Part A continues to apply; where there is a conflict on a subscription‑specific point, Part B governs.

Subscription grant & scope

We grant you a personal, non‑exclusive, non‑transferable, non‑sublicensable, revocable licence to access the Ekhopost features included in your chosen plan for the duration of a paid and active billing cycle.

Your access is limited to the features, generation quotas, connected‑account count, team‑seat count, and other usage limits defined for your plan at checkout (the “Plan Limits”).

Plans & pricing

We currently offer Essentials (from ₹799/mo), Growth, and Agency plans. Each plan’s Plan Limits are defined on the pricing page at the time of purchase and may specify, among other things:

  • monthly limits on AI post generations and image generations;
  • the number of connected social accounts per platform;
  • the number of team members or brand workspaces permitted on one account;
  • inclusion or exclusion of advanced features such as the Idea Lab, article‑to‑post, or scheduled publishing.

Plan Limits are binding. Usage that exceeds your Plan Limits may be throttled, queued, or require an upgrade.

Fees, billing & taxes

All fees are listed in Indian Rupees (INR) and are exclusive of Goods and Services Tax (GST), which will be added at the applicable rate.

Payments are processed by our third‑party payment gateway, Razorpay. We do not store full card numbers. Your use of the gateway is subject to its terms.

Foreign‑currency pricing, where shown, is indicative; the final charge will be in INR unless otherwise stated at checkout.

7‑day free trial

Essentials includes a seven‑day free trial. No credit card is required to start the trial.

At the end of the trial, your account reverts to a limited free state unless you choose a paid plan. We will not charge you automatically from the trial.

The trial is limited to one per person and per business. We reserve the right to end a trial and require payment if we detect abuse.

Auto‑renewal & e‑mandate

Unless you selected a one‑time or manually‑renewed plan, your subscription will renew automatically at the end of each cycle at the then‑current price for your plan, using your registered payment method, in compliance with the RBI e‑mandate framework.

We will send a pre‑debit notification at least 24 hours before each auto‑debit. You may disable auto‑renewal at any time from your account dashboard; disabling takes effect at the end of the current cycle.

Cancellation & refunds

You may cancel your subscription at any time from your account settings. Unless otherwise stated at purchase, cancellation stops the next renewal; it does not refund the current cycle.

Refunds, if any, follow the specific refund policy displayed on the pricing page for your plan. Statutory rights under the Consumer Protection Act, 2019 are preserved.

We may pro‑rate or refund voluntarily in cases of confirmed technical inability to provide the Service for more than 72 continuous hours.

Account sharing & plan limit abuse

A subscription is for the registered user and the seats included in the plan. Sharing credentials outside the seat count permitted by your plan is prohibited.

We use reasonable technical measures (concurrent‑session checks, device fingerprinting, IP‑range analysis) to detect abuse. On detection we may: (i) warn, (ii) temporarily disable additional sessions, (iii) require re‑authentication, or (iv) in repeated cases, suspend the account.

Your content & AI‑generated output

You retain ownership of the brand assets you upload to Ekhopost (logo, palette, voice description, images, product photos) and of the posts you publish to your own social accounts.

You grant us a worldwide, royalty‑free licence to process those assets solely as needed to operate the Service for you — including generating posts and images, applying your brand to them, and delivering them to the social platforms you connect.

You are responsible for having the right to use any material you upload. You will not upload content that infringes third‑party rights, violates applicable law, or breaches the terms of any platform you publish to.

Output generated by the Service is produced by AI. It may contain errors, outdated facts, or unintended resemblances to other works. You are responsible for reviewing every generated post and image before publishing.

Model training: we do not use your brand assets, prompts, or generated output to train foundation models. We may use aggregated, de‑identified telemetry to improve the Service. Any use of customer content for model training will only occur under separate, explicit opt‑in.

Third‑party social platforms

Ekhopost connects to LinkedIn, Instagram, Facebook, and X through their official APIs using OAuth. Your use of those platforms is governed by their own terms, and your authorisation can be revoked by you or by the platform at any time.

We are not responsible for platform outages, rate limits, policy changes, account suspensions, or content decisions made by those platforms. Where a platform restricts what we can publish on your behalf, we will surface that restriction in the app.

You are responsible for complying with the community standards and advertising rules of each platform you publish to. You are also responsible for any disclosures required by law for sponsored or promotional content.

Subscriber acceptable use

In addition to Clause 5, subscribers will not:

  • use the Service to generate or publish unlawful, defamatory, obscene, hateful, harassing, deceptive, or infringing content;
  • use the Service to impersonate a person or organisation you are not authorised to represent;
  • attempt to reverse‑engineer, replicate, or extract the underlying models, prompts, or templates that power the Service;
  • resell or repackage Ekhopost output as your own managed social‑media service, unless you are on an Agency plan and operating within its Plan Limits;
  • intentionally exceed the rate limits of connected social platforms, or use the Service to engage in spam or inauthentic behaviour.

Intellectual property (subscriber level)

Nothing in your subscription transfers ownership of the Ekhopost platform, our models, our prompts, our templates, or our trade marks. These remain the property of Ekhopost and its licensors.

You retain ownership of your brand assets and of the generated output published to your own accounts, subject to Clause 21.

Service changes, downgrades & upgrades

We may add, modify, or discontinue features of a plan. Where such a change materially reduces what you paid for, we will offer a pro‑rata refund or equivalent credit on request.

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with pro‑rated charging; downgrades take effect at the end of the current cycle.

Suspension & termination (subscriber)

We may suspend or terminate a subscription, without refund, for breach of these Terms, chargebacks, payment failure not remedied within 7 days, or fraud.

Termination does not affect accrued rights of either party, including our right to collect unpaid dues.

Limitation of liability (subscriber)

To the maximum extent permitted under Indian law, our aggregate liability to a subscriber for any and all claims in a given 12‑month period is limited to the fees actually paid by that subscriber during that 12‑month period.

We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages — including, without limitation, any loss arising from an AI‑generated post that you reviewed and published.

Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including internet disruptions, DDoS attacks, regulatory actions, natural disasters, pandemics, or outages of third‑party platforms we rely on.

We may serve notice on you by email to your registered address or by an in‑product banner.

Survival & governing law

Clauses on Intellectual Property, Your Content & AI‑Generated Output, Limitation of Liability, Governing Law, and any payment obligation survive termination.

Part B is governed by the laws of India. Consumer disputes may be filed under the Consumer Protection Act, 2019. All other disputes are subject to the jurisdiction clause in Part A.
